By attending NAREIM in-person meetings, attendees agree:

 

Attendee understands that participation in NAREIM meetings is entirely voluntary and requires attendees to abide by any applicable rules of conduct or local or state laws that may be announced at any time during the meeting.

 

In consideration of the right to attend NAREIM meetings, attendee assumes all risks and accepts sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that attendee may experience or incur in connection with attending the meeting.

 

While NAREIM is the convener of the meeting, attendee understands and acknowledges that NAREIM has no direct control over and is not responsible for the acts or omissions of any meeting venue personnel or others involved in producing this event, or any other attendees at the meeting. Attendee has carefully considered the risks involved and hereby releases, covenants not to sue, discharges, and holds harmless NAREIM, its officers, directors, employees, agents, and representatives, of and from any such claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind (including reasonable attorney’s fees) arising out of or relating thereto.

 

Specifically relating to the COVID-19 pandemic, attendee acknowledges the highly contagious nature of COVID-19 and voluntarily assumes the risk of exposure or infection by attending NAREIM meetings, and understands that such exposure or infection may result in personal injury, illness, disability, and/or death to attendee.

Attendee understands that the risk of becoming exposed to or infected by COVID-19 at NAREIM meetings may result from the actions, omissions, or negligence of others who may attend the event or their families, colleagues, or others with whom they may have contact.

Accordingly, attendee understands and agrees that this release includes any claims based on the actions, omissions, or negligence of NAREIM, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in NAREIM meetings.

 

In addition to all other rules and regulations relating to the attendee’s attendance at  NAREIM meetings, attendee agrees to comply with all COVID-related procedures that may be implemented by NAREIM and the venue, including, but not limited to, mask-wearing and social distancing requirements and restrictions on certain activities that carry higher COVID-related risk, in order to protect as much as possible the health and safety of all NAREIM meeting attendees.

By completion and submission of the meeting registration form, attendee certifies that they have read and fully understand this Liability Waiver and Assumption of Risk agreement and understands that it affects their legal rights. Attendee agrees and acknowledges that this waiver and release (1) shall be binding on them, their heirs, family, estate, representatives, and assigns and (2) is intended to be as broad as permitted under applicable law, and each waiver or provision herein is severable and shall apply notwithstanding the invalidation of any other provision herein.
